TERMS & CONDITIONS

INTRODUCTION

These Terms and Conditions contain the terms and policies that govern the use of the services offered by Kusuka on the Site. By accessing and/or using the Site, the User states that they have read, studied and agreed to all of these Terms and Conditions and the Privacy Policy, which together apply to their legal rights and obligations as a legal and binding agreement between the User and Kusuka. Users who do not agree to part or all of the contents of these Terms and Conditions are not permitted to access and use the services provided by the Site.

A. DEFINITION

“Kusuka” means CV. Arira Pangindo and each of its Affiliates.

“Site” means the www.kusukachips.com website owned and operated by Kusuka, which can be accessed via the desktop site.

“User” means every individual who accesses and uses the Site and any services offered therein.

"Registration Form" means the electronic form available on the Site and must be completed with the Personal Data of the User who wishes to register to get an Account on the Site.

"Personal Data" means the information and personal data of a User who wishes to register as a Registered User on the Site, which must be included in the Registration Form, including but not limited to electronic mail address, full name, address and cell phone number.

“Registered User” means any User who has a registered account on the Site.

“Account” means an account on the Site owned by a User.

"Customer" means every Registered User who makes a Product purchase transaction on the Site.

“Recipient” means any individual who is the recipient of the Products purchased by the Customer.

"Law" means any and all provisions of laws and regulations which from time to time apply in the Republic of Indonesia.

“Products” means Kusuka products, which are available to Kusuka Customers.

"Courier" means a third party provider of expedition and/or shipping services, whose services are offered for delivering Products to the Recipient.

“Affiliate” means, with respect to any party, any individual, corporation, limited liability company, partnership or other entity that directly or indirectly has control over, is controlled by, or is under common control with such party.

“Site Terms” means these Terms and Conditions, the Privacy Policy, and any other terms and conditions that may apply to or in connection with the use of the Site and all the features offered on the Site.

B. REGISTRATION AND ACCOUNT

The user hereby declares that he is a competent individual and is able to enter into a legal agreement based on the law.

All Users, without exception, have the right to register as Registered Users and create an Account on the Site free of charge without any fees. Users understand that some services provided on the Site are only available to Registered Users.

When registering, Users are required to provide information and personal data that is accurate, true and complete. Registered Users are also obliged to update their information and personal data from time to time in the event of changes. Kusuka is not responsible for any losses caused by incomplete, inaccurate or not updated information and personal data of Registered Users.

Each Registered User is responsible for the Account, access thereto and the confidentiality of the password and all forms of authentication that may apply/choose. All forms of activity carried out by and on behalf of the Account will automatically be deemed to originate from the relevant Registered User.

Registered Users are independently responsible for maintaining the confidentiality of any registered information and personal data as well as passwords and all forms of authentication they choose. In no case is Kusuka responsible for all losses arising from the failure of Registered Users to maintain the confidentiality of any information and data relating to their Account.

C. TRANSACTION – ORDERING AND PAYMENT

All Registered Users, without exception, have the right to become Customers.

The transaction process takes place from the time the Customer orders the Product via the Site. Customers are obliged to carry out and complete transactions in accordance with the procedures provided by Kusuka on the Site.

When placing an order for Products, the Customer agrees that:

Kusuka has made its best efforts to provide complete and accurate information and descriptions regarding Products, and Customers are responsible for reading, understanding and agreeing to all information and descriptions of the Products before placing an order;

When purchasing a Product, the Customer will enter into a valid and binding agreement based on the Law for purchasing Products with Kusuka; And

Kusuka strives to ensure stock availability of Products displayed on the Site, however Product stock availability may change at any time. In the event that the Customer has made payment and the Product stock turns out to be empty, Kusuka will refund the payment for the Product whose stock is empty.

Customers can choose one of the payment and delivery methods available on the Site.

Customers are required to make payments within 2 x 24 hours of placing an order (in the case of payment by transfer), or within another time period in accordance with the provisions of the payment service provider used. Customers who fail to complete payment within the specified time period will automatically be deemed to have canceled the transaction by the system.

Customers are obliged to make payments in the amount according to the invoice, up to the last digit. Customers who make payments in amounts greater than the invoice amount can report this to Kusuka by attaching proof of payment, and Kusuka will return the excess payment difference to the Customer. Customers who make payments in an amount less than the invoice amount can choose to pay the difference in the underpayment to continue the transaction, or request cancellation of the transaction and a refund of the funds that have been paid.

Customers cannot cancel an order once appropriate payment has been received by Kusuka.

The Customer understands and agrees that problems with delays in the payment process and additional costs caused by differences between the bank used by the Customer and the bank used by Kusuka are entirely the Customer's personal responsibility.

Customers understand and agree not to disclose or submit proof of payment and/or payment data to third parties other than Kusuka. In the event that losses occur as a result of notification or submission of proof of payment and/or payment data by the Customer to any other party, this will be the full responsibility of the Customer.

D. PRODUCT PACKING AND DELIVERY

Product packaging and delivery is carried out on the same day if payment confirmation is received before the cut off time as follows:

All payments received after 12.00 WIB will be packaged and sent the following day.

The customer understands and agrees that Kusuka uses a courier service to deliver the purchased product to the recipient's address. For this purpose, Kusuka will forward some of the Recipient's Personal Data, as necessary, to the Courier. In the event that the Customer is not a Recipient, the Customer hereby states that the Customer has obtained consent for the disclosure and use of the Recipient's Personal Data as necessary for delivery of the Product to the Recipient's address.

The Customer understands and agrees that the process of delivering Products by the Courier will be subject to the terms and conditions of each Courier, at the Customer's choice, and the Customer is advised to check with each Courier to access these terms and conditions. Therefore, any obstacles or problems that occur during the product delivery process are the full responsibility of each courier.

E. CANCELLATION AND REFUNDS

Kusuka has the right to cancel the transaction if the product stock ordered is out of stock. Kusuka will issue refunds for canceled transactions.

Kusuka is not responsible for accepting any claims, except for:

exchange claims in the event that the Product received by the Customer is defective or damaged; And

claims of errors and/or shortages in Product delivery.

F. PROMOTION

Kusuka may from time to time hold promotional activities, in the form of vouchers, bundles and others ("Promotions") with terms and conditions that may differ for each Promotion. Users are required to read and understand each of the terms and conditions that apply to the Promotion before participating in and/or taking advantage of the Promotion offered.

Users understand and agree that some Promotions can only be enjoyed by Registered Users who have verified their registered e-mail address.

G. DELETE ACCOUNT

Registered Users can request Account deletion via the Profile Settings page. Account deletion can only be carried out if the Registered User has verified the e-mail address at the time of Account registration and/or there are no transactions with ongoing status. Applications for account deletion will be processed after a request is sent to the email address cs@kusuka.co.id.

Kusuka will delete all information, data and access to information and personal data belonging to Registered Users in accordance with the provisions of the applicable laws and regulations in the Republic of Indonesia;

Registered Users can contact Customer Service for further assistance and information regarding Account deletion.

H. OTHER PROVISIONS

Users who use each service, participate in each program and/or Promotion available on the Site hereby declare that they have read, understood and agreed to each of the terms and conditions that specifically apply to the service and/or program.

For matters that have not been and/or are not regulated in the terms and conditions for each service, program and/or promotion, these Terms and Conditions will apply.

By agreeing to these Terms and Conditions, Users are deemed to comply with the Site Terms including the Kusuka Privacy Policy.

I. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

Kusuka always strives to ensure that the services provided on the Site are safe, comfortable and function well. However, Kusuka cannot guarantee that the Site can operate continuously or that access to the Site's services can always be perfect. The information and data available on the Site may not always occur in real time.

The User agrees that the User utilizes the services provided on the Site at the User's own risk, and the services provided to the User are provided on an "AS IS" and "AS AVAILABLE" basis.

J. LAW

These Terms and Conditions will be subject to and interpreted in accordance with the laws of the Republic of Indonesia, without regard to conflict of law rules. Users agree that any legal action or dispute that may arise from, or in any way related to, the Site and/or the agreements contained in these Terms and Conditions will be resolved exclusively in the jurisdiction of the courts of the Republic of Indonesia.

K. RENEWAL

Terms & conditions may be changed and/or updated from time to time without prior notice.

Users are advised to carefully read and check this Terms and Conditions page from time to time for any changes. By continuing to access and use the services on the Site, Users are deemed to agree to the changes in these Terms and Conditions.
